CITIZENSHIP

DISCRIMINATORY CLAUSES
To
ensure that Zambian citizenship was only restricted to those persons
who genuinely desire and deserve it, the commission recommends that:

Citizenship by birth and descent should be
retained

Citizenship by registration be retained for a
person who:

Is at least 21 years; and
-
Ordinarily resident in Zambia for 10
years.
Consequently, this means that marriage would no
longer be a ground for entitling a person to apply for citizenship.
This is accepted with the emphasis that except
for minors, dual citizenship should not be accepted in Zambia.

LOSS OF CITIZENSHIP
The
commission considered the loss or deprivation of citizenship to
be a very serious matter. Further, the commission took the view
that citizenship is a primary right and therefore recommends
that no one should be arbitrarily deprived of his/her
citizenship.
This is accepted.
THE
CITIZENSHIP AND IMMIGRATION BOARD
The
commission found the present arrangements relating to the
Citizenship and Immigration Board satisfactory and recommends
their retention.
This is accepted.
RELATED ISSUES: CHILDREN’S PASSPORTS.
The
commission observed that it was an established administrative
practice to seek the consent of both parents whenever a child
applied for a passport. This is partly to ensure that the child was
not taken away from Zambia without the consent of both parents. But
the commission, nevertheless, felt that there is a need to devise an
alternative method, as the current practice was clearly
discriminatory against women.
This is
accepted.
